FCRA Background Check Disclosures

1. Overview

Callme AI partners exclusively with licensed Consumer Reporting Agencies (CRAs) — currently Checkr, Inc. and First Advantage — for all paid background screening reports. Before any report is procured, Callme obtains the candidate's written authorization via the Checkr authorization flow and delivers the FTC-mandated Summary of Your Rights Under the Fair Credit Reporting Act.

2. Before the Report — Authorization & Disclosure

Under FCRA §604(b), before procuring a consumer report for employment purposes, Callme must:

  1. Provide the candidate a clear written disclosure that a consumer report may be obtained for employment purposes.
  2. Obtain the candidate's written authorization.
  3. Provide the candidate a copy of A Summary of Your Rights Under the Fair Credit Reporting Act (FTC official form).

The authorization is stored as part of the candidate's profile and is timestamped. It can be revoked at any time by emailing compliance@huwo.ai.

4. Pre-Adverse Action

If a hiring family intends to take adverse action (not hire, or terminate) based in whole or in part on a consumer report, Callme must:

  1. Provide the candidate with a Pre-Adverse Action Notice.
  2. Include a copy of the consumer report.
  3. Include a copy of A Summary of Your Rights Under the Fair Credit Reporting Act.
  4. Wait a reasonable period (Callme uses 7 business days) before taking final adverse action.

This waiting period allows the candidate to dispute the accuracy of the report before any final decision is made.

5. Adverse Action Notice

After the waiting period, if the family proceeds with adverse action, Callme sends the final Adverse Action Notice containing:

  • The name, address, and phone number of the CRA that furnished the report.
  • A statement that the CRA did not make the decision and cannot provide specific reasons.
  • Notice of the candidate's right to dispute the accuracy or completeness of the report.
  • Notice of the candidate's right to obtain an additional free copy from the CRA within 60 days.

6. Candidate Rights

Under FCRA §606 and §611, candidates have the right to:

  • Receive a copy of any consumer report obtained about them.
  • Dispute inaccurate or incomplete information with the CRA.
  • Request a reinvestigation of disputed items.
  • Have inaccurate information corrected or deleted.
  • Place a security freeze on their credit file.

7. Data Retention

Background check reports are retained for 5 years after the date of procurement, as required by FCRA recordkeeping provisions. Audio recordings from AI interviews are retained for 36 months unless the candidate requests deletion earlier.
