Callme AI Terms of Service

1. Acceptance of Terms

Welcome to Callme AI ("the Service"), operated by Callme Group LLC, a Delaware limited liability company. These Terms of Service govern your use of the Callme AI website (huwo.ai), the Callme H5 web application, the Android and iOS mobile apps, AI Glasses hardware integrations, the Tiger Robot companion, and any features related to family care matching, caregiver interviews, payroll, and household planning.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to any part of these Terms, do not use the Service.

2. Service Description

The Service provides a marketplace that connects families and household employers with caregivers (independent contractors) using AI-assisted caregiver interviews, optional FCRA-compliant background checks, family memory management, home care planning, and related features.

They do not constitute a medical diagnosis, prescription, or the practice of medicine. Please consult a qualified physician, registered dietitian, or other licensed healthcare professional before changing your diet or that of anyone under your care based on results from this Service.

3. Accounts, Security, and Eligibility

• Eligibility. You must be at least 18 years old and located in the United States to open an account and conduct transactions through the Service.
• Account security. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. Notify support@huwo.ai immediately if you suspect unauthorized access.
• Demo / test accounts. Do not use demo or test accounts (such as the published 13800000001 sample account) with real or sensitive personal information.

4. User Conduct & Acceptable Use

You agree not to use the Service to:

• Violate any applicable local, state, federal, or international law or regulation.
• Infringe the intellectual property, privacy, or publicity rights of Callme Group LLC or any third party.
• Disrupt or attempt to disrupt the integrity or performance of the Service, including reverse engineering, probing, crawling at excessive rates, or introducing malware.
• Use AI interview recordings, results, or shift-evidence content (including Glasses footage) for harassment, blackmail, discrimination on protected classes, or other unlawful purpose.

We reserve the right to investigate suspected violations, restrict access to your account, or terminate your use of the Service when we, in good faith, believe a violation has occurred.

5. Independent Contractor Relationship (No Employment or Agency)

Callme Group LLC operates only a technology platform. We do not employ any caregiver listed on the platform. We are not an employment agency, a nurse registry, or a home health agency unless explicitly stated in a state-specific addendum.

Families (employers) and caregivers are independent parties who reach their own employment or services agreements. All wages, payroll taxes, W-2/1099-NEC reporting, benefits, schedules, and workplace safety are the direct responsibility of the contracting family and caregiver. Callme Payroll (§7) is an optional administrative service performed with the explicit instruction of the household employer.

6. Subscriptions, Cancellations, and Refunds

• Free tier. The Free Basic tier remains free forever, subject to reasonable usage limits documented on the Pricing page.
• Paid tiers. Family Premium and Caregiver Pro subscriptions are charged on a monthly, quarterly, or annual basis as selected at checkout. We support U.S. credit/debit cards via Stripe®.
• Cancel anytime. You may cancel online with one click in Account → Billing. No support-call requirement. We do not practice forced-continuity credit billing traps.
• Prorated refunds. Unused months on quarterly or annual plans are prorated on request, subject to the conditions in our FAQ and any promotional terms in effect at the time of purchase.
• Add-ons are non-refundable after fulfillment. Background checks, payroll filings, and Glasses device rentals cannot be refunded after the service has been performed or shipped.

7. Callme Payroll — Optional Service

Callme Payroll is an optional, add-on service that prepares household payroll filings on your instruction and from the data you provide. We use licensed Enrolled Agents and/or Certified Public Accountants for tax sign-off. You remain fully responsible for the accuracy of wages, hours, and employee information you submit. Penalties assessed by the IRS, state, or locality due to incorrect or late-supplied data are your responsibility.

8. Intellectual Property

The Callme AI name, logo, the design of the Service user interface, documentation, and related intellectual property belong to Callme Group LLC. You may not reproduce, republish, or distribute them without prior written permission.

With respect to content you upload (such as profile text, references, photos, and family memory entries): you guarantee the content is legally yours to share, and you grant us a non-exclusive, worldwide, revocable license to host, process, and display it within the scope of providing the Service (matching, household employer previews, AI interview certificate publishing, etc.).

9. Background Checks & FCRA Disclosures

Any Consumer Report obtained through the Service is provided by Checkr® Inc. or another designated Consumer Reporting Agency (CRA) and is subject to the Fair Credit Reporting Act (FCRA).

Before ordering a background check you must: (1) provide a standalone Disclosure & Authorization form to the consumer, (2) have the consumer sign it, (3) if you plan to take adverse action, provide the consumer a pre-adverse-action notice and a copy of the FTC Summary of Rights, observe the required waiting period, and then deliver an adverse-action notice. Callme pre-builds these templates; it remains your legal duty to follow them correctly.

10. AI Interview — Bias Audit & State Disclosures

The Callme AI 6-dimension interview scoring system is independently audited for bias per NYC Local Law 144. The bias audit report (including impact by EEOC-protected groups) is available at /legal/ny-ai-disclosures. For Illinois users, the HB3721 interview disclosure is presented before the interview flow begins and is archived at /legal/il-ai-disclosures.

AI interview scores are advisory. Employers remain solely responsible for final hiring decisions and may not use scores to discriminate on any protected class.

11. Callme Glasses & Tiger Robot — Use & Privacy

• Not continuous surveillance. Both products are strictly event-based. Glasses recording is triggered only by the caregiver for a shift event or by automatic wellness reminders, and is disabled outside scheduled shift hours. Tiger Robot's room camera is only activated for wellness checks or in-app app launch by a household member.
• Access revocation. Video tokens and media links are automatically revoked 7 days after a shift ends, or earlier upon request to support@huwo.ai.
• Senior-care HIPAA option. Families with senior-care use cases may optionally execute a Business Associate Addendum (BAA) for covered PHI. Contact compliance@huwo.ai to set it up.

12. Disclaimer of Warranties

THE SERVICE AND ALL CONTENT PROVIDED THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. CALLME GROUP LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND PARTNERS HEREBY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We endeavor to restore service after interruptions caused by network outages, third-party service failures, or force majeure, but are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages. Nutrition and calorie data are estimates and may contain errors.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CALLME GROUP LLC'S AGGREGATE LIABILITY, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS ACTUALLY PAID BY YOU TO CALLME IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

14. Arbitration Agreement & Class Waiver

Any dispute arising out of or relating to these Terms or the Service will be resolved by binding, individual arbitration before the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The Federal Arbitration Act, 9 U.S.C. §§ 1–16, governs the interpretation and enforcement of this arbitration clause.

YOU UNDERSTAND THAT BY AGREEING TO ARBITRATION YOU ARE WAIVING YOUR RIGHT TO JURY TRIAL AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION AGAINST CALLME GROUP LLC. Nothing in this clause prevents either party from seeking individual injunctive relief in a court of competent jurisdiction where necessary to protect its trade secrets or intellectual property pending the outcome of arbitration.

15. Modification of Terms & Termination

We may modify these Terms from time to time. Material changes will be notified via in-app banner or email 30 days before becoming effective. Your continued use of the Service after the effective date of modified Terms constitutes your acceptance.

Either party may terminate this agreement: you by closing your account; we by giving you 30 days' notice via email, or immediately for material breach (including, without limitation, violations of §4 acceptable use or fraud in connection with any transaction).

16. Governing Law & Disclosures

• Governing law & venue. These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any court proceeding permitted under §14 (or to compel or confirm arbitration) shall be brought exclusively in the federal or state courts located in New Castle County, Delaware.
